Terms of Service
1. Agreement to these terms
These Terms of Service govern the use of this website and the construction and building services provided by HSAD Construction Pty Ltd (ABN 83 702 735 073) of Melbourne VIC. By engaging our services, requesting a quotation, or using this website, you agree to these terms. If you do not agree, please do not use this website or engage our services.
2. Quotations and estimates
All quotations provided by HSAD Construction Pty Ltd are valid for 30 days from the date of issue unless otherwise stated in writing. Quotations are based on the scope of works, site conditions and information available at the time of preparation. Estimates given without a detailed site inspection are indicative only and are not a fixed price.
3. Scope of works and variations
Work will be carried out in accordance with the written scope agreed between the parties. Any change to the scope, including additional works, alterations to materials, or unforeseen site conditions, will be documented as a written variation. Variations will only proceed after they have been approved and signed by you, and any adjustment to price or time will be set out in the variation.
4. Pricing and payment
Prices are stated in Australian dollars and include GST where applicable. Payment terms, progress claim schedules and deposit amounts will be set out in your contract or quotation. Progress claims are payable within the period stated on the claim. Overdue amounts may attract interest or recovery costs as permitted by law and as set out in your contract.
5. Access and site conditions
You agree to provide safe and reasonable access to the worksite at agreed times, and to ensure the site is free of hazards not otherwise disclosed to us. Where asbestos, structural defects, concealed services or other latent conditions are discovered, we may pause work, adjust the program and issue a variation for the additional work required.
6. Statutory warranties and Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law, being Schedule 2 of the Competition and Consumer Act 2010 (Cth), or any other applicable law that cannot be excluded. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For services, you are entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure is not a major failure, you are entitled to have the failure remedied in a reasonable time.
7. Workmanship and materials
We carry out all works with due care and skill, in a proper and workmanlike manner, and in compliance with the Building Act 1993 (Vic), relevant Australian Standards and applicable building permits. Manufacturers' warranties may apply to materials and fixtures supplied; we will pass on the benefit of those warranties to the extent we are able.
8. Limitation of liability
To the fullest extent permitted by law, our liability for any claim arising from our services is limited to the cost of re-supplying the affected services or paying for them to be re-supplied, except where the Australian Consumer Law or other legislation provides otherwise. We are not liable for indirect or consequential loss, including loss of profit or loss of use, where such exclusion is permitted by law.
9. Delays
While we aim to complete works within the agreed timeframe, delays may occur due to weather, site conditions, supplier availability, permit authorities or other causes beyond our reasonable control. Where a qualifying cause of delay occurs, the practical completion date will be extended fairly and we will notify you in writing.
10. Defects and rectification
If you identify a defect in our workmanship, please notify us in writing as soon as practicable. Subject to your contract and applicable statutory warranty periods, we will attend to rectify defects arising from our workmanship at no cost to you within a reasonable time of notification.
11. Cancellation and termination
Cancellation rights, notice periods and any applicable cancellation charges will be set out in your building contract. Statutory rights of termination under Victorian building legislation and the Australian Consumer Law are not affected by these terms.
12. Privacy
We handle personal information in accordance with our Privacy Policy. That policy explains what information we collect, why we collect it and how you may seek access to or correction of your information.
